Authenticity

Consignment Chic requires it's partner stores to sell only authentic merchandise.   Each store does it's best to authenticate the items brought in by their suppliers to sell on their behalf and truly believes the merchandise they are selling is authentic.  We want you to have 100% confidence in your purchases on Consignment Chic.  If you purchase an item through one of our partner stores that you believe is not authentic, ask that store for a refund.  If you are not satisfied with the resolution offered from that store, send us a written explanation of your situation to Consignment Chic, LLC, 1058 Montgomery Hwy, Vestavia Hills, AL  35216 or fax to (205) 822-3991.

COPYRIGHT AND INTELLECTUAL PROPERTY POLICY


Consignment Chic respects the intellectual property of others and has adopted this policy to help protect others’ intellectual property interest and in accordance with law.  Consignment Chic may, in appropriate circumstances and at its discretion, terminate the accounts of users who infringe the intellectual property rights of others and/or remove any allegedly infringing material.
If you believe that any material, whether copyrighted work or trademarks, on the www.consignmentchic.com website (the “Site”) is infringing upon your intellectual property rights, please provide Consignment Chic’s Copyright Agent the following information at the contact information below:
1. A description of the material that you believe has been infringed;
2. A description of where the material that you believe is infringing is located on the Site;
3. Your address, telephone number, and email address;
4. A statement by you that you have a good faith belief that the disputed use is not authorized by the intellectual property owner, its agent, or the law;
5. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the intellectual property owner or authorized to act on the intellectual property owner’s behalf; and
6. An electronic or physical signature of the person authorized to act on behalf of the owner of the intellectual property owner.

A copy of the notice and the notifying party’s contact information may be provided to the person or entity responsible for posting the allegedly infringing material (the “Responsible Party”).

If the Responsible Party believes that its material that was removed (or to which access was disabled) is not infringing, or that it has the proper right to post the removed material, the Responsible Party may send a counter-notice containing the following information to the Copyright Agent:
1. The Responsible Party’s physical or electronic signature;
2. Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
3. A statement that the Responsible Party has a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and
4. The Responsible Party’s name, address, telephone number, and e-mail address, a statement that the Responsible Party consent to the jurisdiction of the federal court in the judicial district where the Responsible Party’s address is located and that the Responsible Party will accept service of process from the person who provided notification of the alleged infringement.
If a counter-notice is received by the Copyright Agent, Consignment Chic may send a copy of the counter-notice to the original complaining party informing that party that unless the purported intellectual property owner files an action seeking a court order against the Responsible Party, Consignment Chic may replace or restore access to the removed content in ten to fourteen business days or more after receipt of the counter-notice, at Consignment Chic’s sole discretion.
